You may not otherwise copy, reproduce, distribute, transmit, display, publish, modify, create derivative works from, or exploit the Site.

Ownership and Intellectual Property Rights

This Site and its content, design, and technology are owned by or licensed to the Firm and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms of Use grants you any license to use the Firm’s name, logo, or other intellectual property except as expressly permitted here.

Any unauthorized use automatically terminates the license granted to you under these Terms.

No Relationship or Obligation Arises from Use of the Site

The law differs in every jurisdiction, and you should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fully informed of your specific facts, and who is licensed in the applicable jurisdiction. You should seek professional counsel about your legal rights and remedies and should not act, or refrain from acting, based on information found on this Site. The Firm expressly disclaims all liability with respect to actions taken or not taken based on any information or other content of this Site. Viewing this Site, or communicating with the Firm by internet, email, text, telephone, or through this Site, does not constitute or create an attorney-client relationship. The content and features of this Site, including any means to submit a question or information, do not constitute an offer to represent you and do not give rise to an attorney-client relationship.

Disclaimer of Warranties

This Site is provided “AS IS.” The Firm makes no warranties, express or implied, regarding the Site, and hereby disclaims all warranties of any kind or nature, including without limitation the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Firm does not guarantee that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.

Confidentiality Is Not Guaranteed

Information sent to the Firm via the internet, email, text, or through this Site is not secure. Regardless of the method of communication, including by telephone, information you share with the Firm is not protected by the attorney-client privilege and is not treated as confidential unless and until the Firm has agreed in writing to represent you. The Firm makes reasonable efforts to keep communications private, but because of the nature of these communications and the absence of an attorney-client relationship prior to formal engagement, confidentiality and privilege cannot be promised or guaranteed.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Firm and Attorney Lavey from any claims, losses, liabilities, damages, and costs (including reasonable attorneys’ fees) arising from your access to or use of the Site, or your breach of these Terms of Use.

No Medical Diagnosis or Advice

The content on this Site, including any text, graphics, or informational articles, is provided for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician regarding any health concern, and never delay seeking medical advice because of something you have read on this Site.

The Firm Is Not Responsible for Content

The Firm may change, remove, or add material to the Site without notice, and such material may contain technical or typographical errors. The Firm does not guarantee the accuracy, completeness, or suitability of any information on the Site and assumes no liability for any errors or omissions. Your use of the Site is at your own risk.

Limitation on Liability

To the fullest extent permitted by applicable law, the Firm shall not be liable to you or any other person for any lost profits, or for any indirect, special, incidental, or consequential damages of any kind, arising from or relating to these Terms of Use or your access to or use of the Site, even if the Firm was advised of the possibility of such damages.

Third-Party Websites

This Site may contain links to third-party websites for the convenience of visitors. The Firm does not endorse, control, or take responsibility for the content or practices of any third-party website, and use of any linked site is at your own risk.

Massachusetts Law; Statute of Limitations

The laws of each state differ, and this Site contains general information that may not apply outside Massachusetts. Massachusetts, like every state, has filing deadlines known as statutes of limitations that apply to personal injury and other civil claims; a claim filed after the applicable deadline may be barred regardless of its merits. Claims against government entities may be subject to separate, shorter notice requirements. Because identifying the correct deadline requires investigation specific to your situation, you should consult an attorney as soon as possible after an accident or injury.

Contingency Fee Disclosure

The Firm handles personal injury, workers’ compensation, and Social Security disability matters on a contingency fee basis in appropriate cases, meaning no attorney’s fee is owed unless a recovery is obtained on your behalf. For most personal injury matters, contingency fee percentages are not fixed by statute and are set by agreement between the Firm and the client. Massachusetts law imposes specific statutory limits on contingency fees in medical malpractice cases (M.G.L. c. 231, § 60I), which cap attorney fees on a sliding scale based on the amount recovered. Depending on the outcome of a matter, a client may remain responsible for court costs and case expenses even where no attorney’s fee is charged. Contingency fee arrangements are not available for criminal defense matters. The specific terms of any fee arrangement, including any applicable percentage, statutory limits, and the client’s responsibility for costs, will be set out in a written engagement agreement before representation begins.

Referral and Co-Counsel Arrangements

The Firm does not handle every case type. When appropriate, the Firm may refer a prospective client to another attorney or law firm, or may associate with other counsel on a matter, when the Firm determines that doing so would benefit the client’s case. By seeking representation from the Firm, you consent to the Firm disclosing relevant case information, including information that would otherwise be confidential, to any attorney or law firm to whom your matter is referred or with whom the Firm associates as co-counsel, solely for the purpose of evaluating or handling your case. Any referral or co-counsel arrangement, including any fee-sharing between attorneys, will be conducted in accordance with the Massachusetts Rules of Professional Conduct, including any required client consent.

Advertising Disclosures

This website is attorney advertising. Prior results do not guarantee a similar outcome, and no representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.

Jurisdictional Limitation

The Firm does not seek to represent any person who wishes to retain the Firm on the basis of viewing this Site in a state or jurisdiction where doing so would fail to comply with the laws and ethical rules governing attorney advertising and solicitation in that jurisdiction. Attorney Jeffrey C. Lavey is licensed to practice law only in the Commonwealth of Massachusetts, and this Site is not intended to solicit business from residents of any jurisdiction where such solicitation would be improper.

Governing Law

These Terms of Use are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.

Dispute Resolution

Any dispute arising out of or relating to these Terms of Use or your use of the Site shall be resolved through binding arbitration, and both you and the Firm waive the right to a jury trial.

Other Terms

The Firm’s failure to act on any breach of these Terms does not waive its right to act on that breach or any future breach. These Terms of Use, together with the Firm’s Privacy Policy, constitute the entire agreement between you and the Firm regarding your use of this Site.
